There is a landmark case in English Law, ‘Rylands v. Fletcher’, the ruling of which states that a person who is the owner of property, is responsible for the loss or damage sustained by someone else as a result of any action on or by his property, which is due to his (owner’s) negligence and cannot be attributed to God or Nature.
The dispute in ‘Rylands v. Fletcher’ in brief was that Mr. Rylands had a water reservoir from which water leaked and entered mines owned by Mr. Fletcher causing him damage and loss. The case was finally settled in favor of Fletcher, and Rylands had to compensate for the loss.
You may not know it, but English Common Law is the basis and source of legal systems almost all over the world and the above case is considered as a precedent or premise to base judgments on. Lawyers also base their arguments on it. If you inadvertently or otherwise, cause damage to someone on your property or through the mishaps on your property you can be held responsible for it. This also includes legal liability.
You can be held liable for:-
1. Causing environmental hazards.
2. Injuries sustained by others on your property.
3. Loss or damage caused to others, by some action on, or by your property.
4. Third party arrangements, if your property is connected by way of mortgage or some other form of financial contract or agreement.
5. Failure to maintain your property so as not to be the cause of damage to others.
You can protect yourself from many of the risks and liabilities involved by securing your property after a loss or disaster.
